On 21 September 2021, the Consumer Court ordered the luxury hotel chain ITC to pay Rs 2 crore as compensation to the victim woman for wrongly chopping her hair. Now the Supreme Court has stayed this decision of the National Consumer Disputes Redressal Court (NCDRC) on Tuesday.
The court said that NCDRC did not see any evidence before fixing the compensation, so consider it afresh. Justice Aniruddha Bose and Justice Vikram Nath's bench said that the compensation should be fixed on the basis of evidence and not on the basis of the claim of the victim. On what basis and how much will the compensation be? NCDRC should decide this.
Actually, the matter was of April 2018, on which the court had given its decision on 21 September. ITC Maurya Hotel cut the long hair of a model named Aashna Roy and gave the wrong hair treatment. Because of this, he suffered a big loss. Her lifestyle changed and her dream of becoming a top model was shattered.
The hotel was accused of not only cutting the woman's hair but also of medical negligence in hair treatment. Aashna's scalp was burnt, with prolonged allergic reactions and itching. It is clear from the WhatsApp chat provided by Aashna that the hotel had accepted its mistake and tried to cover up its mistake by offering free treatment. The hotel was given 8 weeks to pay the compensation.
