Supreme Court gives blow to chef Kunal Kapoor, stays divorce granted by HC on grounds of cruelty
SC: The High Court, while approving the divorce in April this year, had said that the woman's behavior towards Kunal Kapoor was not dignified and sympathetic. However, now the Supreme Court has stayed this order.
Celebrity chef Kunal Kapoor has got a big blow from the Supreme Court. The apex court has stayed the order of the Delhi High Court, which granted him a divorce on the grounds of cruelty by his wife.
On the petition of Chef Kapoor's wife, a bench of Justices Hrishikesh Roy and SVN Bhatti referred the matter to the Supreme Court Mediation Center to explore the possibility of its settlement.
Earlier, in April, the High Court, while approving the divorce, had said that the woman's behavior towards Kunal Kapoor was not dignified and sympathetic. The Family Court had refused to grant him a divorce. After that Kapoor approached the High Court. The court had said that it is clear in the law that making careless, insulting, and baseless allegations against a spouse in public is tantamount to 'cruelty'.
Justice Suresh Kumar Kait and Justice Neena Bansal Krishna had said in the judgment that if one spouse has such a nature towards the other, then it disrespects the basic spirit of marriage and there is no reason why they should be forced to suffer long-term torture while living together.
Kunal got married in April 2008 and his wife gave birth to a son in 2012. Kapoor alleged in his petition that his wife never respected his parents and insulted them. On the other hand, the woman claimed that he made false allegations to mislead the court. She said that she always talked to her husband like a spouse and was loyal to him. She alleged that Kunal kept her in the dark and fabricated fake stories to get a divorce.
