A government school teacher in Delhi accidentally reached Indira Gandhi International Airport with live cartridges with her. The airport management lodged an FIR against him at the police station under section 25 of the Arms Act 1959. When the matter reached the court, the judge, after knowing the teacher's side, dismissed the FIR, as well as sentenced him to give extra classes to the children.
In fact, the teacher had filed a petition in the High Court demanding to quash the FIR. During the hearing, the teacher told the court that the cartridges recovered from him were found lying on the road in Chamoli, Uttarakhand in 2008-09, when he himself studied in the school. Since then this cartridge is with them and they mistakenly took it to the airport.
After knowing the teacher's side, Justice Jasmeet Singh ordered the teacher to teach weak children in extra classes for one month in his school. The judge has directed the Directorate of Education to prepare a list of vulnerable children of primary class in the area.
At the same time, the principal of the school has also been asked to arrange a room in the school where extra classes of two hours will be held daily. In this, it will be necessary to follow all the Covid protocols. The judge said that the education officer and the principal will have to ensure that the order is being followed.
The court held that the present case deserves to be quashed, as the teacher's bag was left with live cartridges just because of not paying attention, they did not knowingly carry it with them. However, a significant time for the police was wasted in this matter, so the petitioner should do some work for the betterment of society.
