The Rajasthan High Court has expressed strong displeasure over the physical examination of prisoners in the state. Referring to the Bharatpur massacre, the division bench of CJ AG Masih made a verbal remark that when we have said that physical examination of prisoners should be done only in special circumstances, then why was the prisoner being taken by bus to Bharatpur for examination?
The court told the government that you have seen its result. The prisoner was murdered on the bus. During this, not only the safety of the common people was threatened, but along with the loss of time of the jail guards, the roadways were also damaged. Along with this, the court has also asked the government in which jails the facility of VC is not available. What are the reasons for this? Along with this, the court has also asked the government to present the compliance report on 45 points given by the court. The High Court gave these instructions while hearing the case of suo motu cognizance related to the arrangements in the jail.
During the hearing, amicus curiae Prateek Kasliwal had told the court that the state government was not serious about following the court orders. The court asked the prisoners to appear before the VC, but the prisoner was taken by bus and during this, he was killed. On this, the court said that we are aware of this fact. The state government has seen the consequences of disobeying the order.
The court asked AG MS Singhvi, who is appearing on behalf of the government, why every prisoner is not produced before the VC. On this, AG said that many times the court itself refuses VC. On this, the court said that there would not be enough resources. The government should see that the facility of VC is available everywhere. The court asked the state government what is the provision regarding compensation in case of the death of the prisoner. Responding to this, the AG said that the bill is being presented in the assembly on Tuesday. It has made many provisions for the prisoners.
In Bharatpur, the accused in the murder of BJP leader Kripal Jaghina were shot dead on July 12 while being taken from Jaipur to Bharatpur for production. The incident took place near Amoli toll plaza at around 12 noon. Accused Kuldeep Jaghina and his accomplice Vijaypal were being taken by the police bus to the Bharatpur court for production. When the bus stopped at Amoli toll plaza, the miscreants present there boarded the bus. He put chili in the eyes of the policemen. After this, Kuldeep was killed by firing about 15 rounds. Another accused Vijaypal was injured in the incident. Two passengers were also shot in the incident.
