Delhi High Court pronounces order in Amrapali Groups case, Anil Kumar Sharma gets bail with conditions

The Delhi High Court has granted bail to Anil Kumar Sharma, former CMD of Amrapali Group. Let us tell you that a case related to cheating with home buyers in the housing project was registered against Anil Kumar Sharma.

Delhi High Court Justice Vikas Mahajan's bench issued an order passed on September 1. The order observed that the allegations against the petitioner- Anil Kumar Sharma may be serious, but they do not warrant the application of the exception provided in the first proviso to Section 436A of CrPC for its continuance. The petitioner is not to be detained for more than half of the maximum period of imprisonment specified for Section 420 IPC, as it is not the case of the prosecution that the petitioner is in any way responsible for the delay in the trial.

Let us tell you that on 28 February 2019, Anil Kumar Sharma was arrested. Co-accused Shiv Priya and Ajay Kumar were also arrested along with him. Now the court has granted him bail.

The court noted that the Economic Offenses Wing (EOW) of the Delhi Police had filed the charge sheet under sections 406/409/420/120B of the Indian Penal Code (IPC). Later only Section 420/120B of IPC was framed.

The Court noted that the petitioner was granted bail only after furnishing a personal bond of Rs 1 lakh and two sureties of like amount. Apart from this, the court has also imposed many other conditions.

Pramod Kumar Dubey, counsel for the petitioner, submitted that the maximum punishment for the offense under section 420 of the IPC is 7 years. Wherein, the petitioner was in custody for more than 3 years and 6 months.

Pramod Kumar Dubey further said that the prosecution has cited more than 50 witnesses. The decision on this matter will come after a long time. Because of this, the petitioner has requested the court to grant bail.

Advocates Pramod Kumar Dubey, Amit Sinha, Manoj Kumar Singh, Aditi, Satyam Sharma, and Saurav Kumar Sohi were involved in the Anil Kumar Sharma case.
