Without the permission of the Central Government, now the Central Armed Police Force personnel posted in Jammu-Kashmir and Ladakh will not be arrested. The Central Government has decided to provide protection from arrest to the Paramilitary Force (CAPF) personnel under Section 45 of the CrPC. According to the news of the Indian Express, earlier in Jammu and Kashmir, only army personnel were protected from arrest.
The Ranbir Penal Code, 1989 was earlier applicable in Jammu and Kashmir. After the abrogation of Article 370, the Law Department of the Ministry of Home Affairs sent a proposal to bring all jawans posted in Jammu and Kashmir and Ladakh under Section 45 of the CrPC. The Home Ministry agreed to the proposal after consulting the Law Department of Jammu and Kashmir and the Union Ministry of Justice.
According to Section 45 of the CrPC, no member of the Central Armed Forces can be arrested for acts done in the course of official duty without the consent of the Central Government. However, cases can still be registered against vans.
The Central Armed Police Force (CAPF) consists of Assam Rifles (AR), Border Security Force (BSF), Central Industrial Security Force (CISF), Central Reserve Police Force (CRPF), Indo Tibetan Border Police (ITBP), National Security Guard (NSG) ) and Sashastra Seema Bal (SSB).
