Ban on Civic Chandran's bail: Transfer of bail judge; Kerala HC said - the comment describing women's clothes as provocative is not correct
The Kerala High Court has stayed the bail of 74-year-old writer Civic Chandran. The decision came on the demand of the state government in which an appeal was filed against the sessions court's decision to grant bail to Chandran. Justice Kausar Edappagath said- "Under Section 354A of the IPC, the observation of the trial court that the woman was wearing provocative clothes cannot be justified."
Earlier on August 12, Kozhikode Sessions Court Judge S Krishnakumar had granted him bail in a sexual assault case last week, saying the woman's clothes were provocative. Can't believe that Divyang must have forcibly made him sit in his lap.
Kozhikode's session S Krishna Kumar, who gave a controversial verdict on women's clothing, has been transferred. Krishna Kumar was sent to the Labor Court in Kollam under an order of the Kerala High Court late on Tuesday night. Now in Kozhikode, Sessions Judge S Krishnakumar will be replaced by S Muralikrishna.
The accused Civic Chandran had also produced photographs of the woman along with the bail plea in the Kozhikode sessions court. The verdict of the case registered 6 months ago came on 12 August. While granting bail to Chandran, the court had also asked how it was possible that a 74-year-old physically challenged person sexually assaults the complainant by forcibly making her sit on his lap.
The counsel for the accused P. Hari and Sushma M argued that it was a false case. Some of his enemies have filed a false case against the accused to take revenge. The lawyer also said that the case was registered after two years of the incident, but the reason for this delay was not given.
The complainant is a young writer. She alleges that in February 2020, she was at an event on Nandi beach when Civic Chandran tried to outrage her modesty. Koyilandi police registered a case against the accused under sections 354A(2), 341 and 354 of the IPC.
Civic Chandran has two cases of sexual harassment registered against him. The first case was registered in April by a woman belonging to a Scheduled Tribe. He was granted anticipatory bail on August 2. Now anticipatory bail has been granted in the second case also. However, Chandran is absconding since the first case was registered.
