All eyes once again on Supreme Court regarding Electoral Bond, petition filed in SC for reconsideration
A petition has been filed in the Supreme Court requesting reconsideration of the February 15 decision in which the Modi government's electoral bond scheme for political donations was cancelled. Nedumpara claimed in his petition that the court failed to take into account that public opinion could vary on the matter.
A petition has been filed in the Supreme Court requesting reconsideration of the February 15 decision in which the Modi government's electoral bond scheme for political donations was cancelled.
The review petition filed by lawyer Mathews J. Nedumpara said that this court has considered the petition (against the plan). The court struck down the scheme without taking into account that by doing so it was acting as an appellate authority on Parliament. The petition said that the court exercised its discretion on a matter which falls within the exclusive domain of legislative and executive policy.
Nedumpara claimed in his petition that the court failed to take into account that public opinion could vary on the matter. The majority of people in this country would probably be in support of this scheme, which has been brought into existence by their elected representatives. Apart from those who file the petition, they also have the right to have their side heard.
It is known that the Constitution Bench of five judges headed by Chief Justice DY Chandrachud cancelled the Electoral Bond Scheme of 2018 on February 15. The Constitution Bench had termed this scheme as a violation of the constitutional right to freedom of expression and right to information.
